I’ve already respond­ed to the mer­its of the case and the hypocrisy of its phras­ing. Why not sim­ply with­draw the anal­o­gy alto­geth­er? Because the fil­i­buster has 214 years of tra­di­tion, and judges have been fil­i­bus­tered since San­to­rum has been a Sen­a­tor. So the state­ment, like San­to­rum him­self, is wrong and offensive.
