However, in Luttig’s dissent, the judge argued that since there were only 43 known Red Wolves in North Carolina, the issue cannot possibly be one of “interstate commerce”, and hence is out of the jurisdiction of the federal legislature.
This is a view that the conservative 4th Circuit and the current Supreme Court have rejected soundly. This is an extremist wacko, and should enjoy no support even from Republican senators.
