FISA does not autho­rize war­rant­less taps against Amer­i­can cit­i­zens for more than 15 days, and those 15 days have to fol­low a dec­la­ra­tion of war. War­rant­less search­es can last up to a year, but only if:

there is no sub­stan­tial like­li­hood that the sur­veil­lance will acquire the con­tents of any com­mu­ni­ca­tion to which a Unit­ed States per­son is a party

This was unjus­ti­fied and unlawful.

And I’ve lost all respect for John McCain. On This Week with George Stephanopou­los, he basi­cal­ly said that the pres­i­den­t’s actions are jus­ti­fied if he con­sults with the Con­gres­sion­al lead­er­ship. This is undoubt­ed­ly the stu­pid­est thing any­one can say. Con­sult­ing with Con­gress is not the same as pass­ing a law, nor is it the same as get­ting a war­rant. George Stephanopou­los con­sults with the Con­gres­sion­al lead­er­ship reg­u­lar­ly, too, but he does­n’t get to read my email, and nei­ther does the President. 

Fur­ther­more, Nan­cy Pelosi does­n’t recall being con­sult­ed about this pro­gram, so the whole thing is up in the air.

There need to be Con­gres­sion­al hear­ings, and they need to be pub­lic, because I want to know if my phone calls have been mon­i­tored or my emails read.
